1. SCOPE OF SERVICES
These Terms of Service ("Terms") govern the access and use of the Bouqify e-commerce platform by business customers ("Customer", "You"). By subscribing to our services, You confirm that You are acting as a business entity (B2B) and not as a "Consumer" under EU/UK Consumer Laws.
2. LICENSE AND ACCESS
Bouqify grants You a limited, non-exclusive, non-transferable, revocable license to use our SaaS platform for your internal business operations during the subscription term. We retain all intellectual property rights.
3. SUBSCRIPTION AND PAYMENTS
- Fees: Fees are billed in advance on a monthly or annual basis as per the selected plan.
- Taxes (VAT/GST): Since Dijiyama Ltd. is based in Türkiye, for EU/UK B2B customers, the "Reverse Charge Mechanism" may apply. Prices displayed exclude VAT unless stated otherwise.
- Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing cycle.
4. NO RIGHT OF WITHDRAWAL (Cooling-off Period)
You acknowledge that the Service is digital content provided immediately upon subscription. As a business customer, You waive any right of withdrawal (14-day cooling-off period) that might otherwise apply to consumers under EU Directive 2011/83/EU or UK Consumer Contracts Regulations. Refunds are only provided at our sole discretion or in case of a material breach by Bouqify.
5. LIABILITY LIMITATION
To the maximum extent permitted by applicable law (GDPR excluded), Bouqify's total liability for any claim arising out of these Terms shall not exceed the total amount paid by You to Bouqify in the 12 months preceding the event giving rise to the claim. We are not liable for indirect damages or loss of profit.
6. GOVERNING LAW
These Terms shall be governed by the laws of Türkiye. However, for EU customers, mandatory local laws regarding data protection shall remain unaffected.
